Wow. Just wow. I'm not very knowledgeable about law, but don't these kinds of things usually carry mandatory minimum sentences?

This says possession of an assault weapon is a Class D Felony with a mandatory one year sentence. I'm not sure how accurate it is or what it means for Aldon, but it's obviously not good. I'd be surprised if he played at all again this year.

That doesn't sound very good for him. I assume 3 separate charges would mean a mandatory 3 year sentence?

Man... players these days have so much to lose, why do crap like this? The amount of money, fans, etc is just way to much to throw away this kind of stuff. Smarten up!

If it makes Niners fans feel better, at least you didn't guarantee him 12 million dollars before finding out about this.

Lets be fair. When he was drafted he was like what, 20 years old? If someone made me famous and gave me millions of dollars when I was 20 years old I would have gotten in loads of trouble too.

Getting drunk and kicked out of clubs type trouble? Understandable.

Felony assault weapon charges type trouble? Dumb.

Two of my favorite players in the league Aldon and Von Miller are both idiots. What a shame. If they only knew how big of inspirations they were on kids and football players alike.

Exactly. If I were a millionaire right now, I might be going around partying every now and then.

But carrying an illegal assault weapon on me to parties and hanging out with gangbangers?

Nah.

More on the story:

Quote:
It is unclear why it took more than a year for deputies to turn the case over to prosecutors in July following last summer's party at Smith's rented 8,000-square-foot-house in the foothills near San Jose.

There is a part of me that thinks that the long amount of time that this "investigation" took is a bad omen for the DA. I know that the Santa Clara DA has been under a lot of scrutiny for appearing to favor the wealthy and famous. Further, when the civil suit against Smith came out, people started inquiring as to why there were no criminal charges stemming from the same incident which seems to have ultimately led to this. I don't think these offenses have a minimum 1 year sentence. I believe the minimum is probation.

Lastly, I'll jump on my soapbox. Its absolutely ridiculous that something can be deemed completely legal and socially acceptable in one state while at the same time be the bane of society in another. What made the rifles illegal in California was probably something as silly as having a magazine release.

Kind of sucks that Smith could be going to prison for a year for something that's legal in most states.

It pisses me off so much that SO many NFL players in the past(and now Smith) always get slapped with this stupid charge.............like how hard is it to go get a gun permit and register your weapons.....
